These Terms of Service govern your use of Racount's websites, web application, mobile applications and related products and services. By creating an account or using Racount, you agree to these terms. When you make a purchase, the product information and any additional terms shown before payment also apply.

1. Using Racount
Racount lets you create and manage travel records, trips, custom counts, moments, media, notes, shared experiences and social interactions. Features may vary by device, platform, location and account type.
You must provide accurate account information, keep your sign-in details secure and tell us promptly if you believe somebody has accessed your account without permission. You are responsible for activity carried out through your account unless applicable law says otherwise.
You must be legally capable of agreeing to these terms. If you are below the age at which you can enter into a contract where you live, a parent or legal guardian must agree on your behalf.
2. Acceptable Use
You must not use Racount to create, upload, share or distribute content that is unlawful, harmful, abusive, threatening, deceptive, defamatory, discriminatory, sexually exploitative, invasive of privacy or intellectual-property rights, or that otherwise infringes another person's rights.
You must not interfere with the operation or security of Racount, attempt unauthorised access, introduce malicious code, scrape the service in breach of applicable law, misuse another person's account or use Racount to facilitate fraud or other unlawful activity.
We may remove content or restrict access where reasonably necessary to enforce these terms, protect users, comply with law or keep Racount secure.
3. Your Content
You retain ownership of content you create. You give Racount a worldwide, non-exclusive licence to host, store, reproduce, process, adapt, transmit and display that content only as reasonably needed to operate, secure and improve the service and provide the sharing, social, collaboration, backup and export features you choose to use.
You confirm that you have the rights and permissions needed to add and share your content. Your visibility choices determine whether content is private, shared with particular people or visible more widely. Content contributed to a shared trip may remain part of the shared record available to other authorised participants, subject to the removal and account controls Racount provides.
4. Racount Products and Purchases
Racount may offer digital products and paid features, including permanent feature unlocks, Count Packs, shared or collaborative trip features and other extras. Racount may also offer physical or personalised products such as prints, postcards or posters. The product description, price, currency, applicable taxes, delivery method and any platform-specific conditions are shown before purchase.
Unless a product is expressly described as a subscription, it is a one-time purchase and does not create a recurring payment obligation. A digital purchase gives you a personal, non-exclusive and non-transferable right to use the relevant feature or content through the purchasing Racount account, subject to these terms and applicable law. Purchases and Racount accounts may not be sold or transferred.
Website payments may be processed by Stripe or another payment provider identified at checkout. Purchases made in a Racount mobile application may be processed by Apple App Store, Google Play or another authorised store. App-store purchases are also governed by the relevant store's terms, billing rules and refund process. Prices may differ between platforms or countries because of currencies, taxes, store pricing tiers or platform fees.
5. Digital Delivery and Account Access
Digital products are normally made available to the Racount account after the payment provider confirms payment. Confirmation can occasionally be delayed by the payment method, network conditions or payment provider. Racount will continue processing a valid purchase and will show the entitlement in the Purchases & Extras area once confirmed.
You must complete a purchase while signed in to the Racount account that should receive it. Eligible website purchases follow that Racount account across supported devices. Mobile purchases may be restored through the applicable app-store process and linked to the signed-in Racount account after validation.
If a payment is reversed, refunded, charged back, disputed or found to be fraudulent, Racount may suspend or revoke the corresponding entitlement. Where appropriate, content already created using an entitlement may become read-only rather than being deleted.
6. Refunds and Cancellation
Refund and cancellation rights depend on the product, the purchase channel and the laws that apply where you live. Racount does not offer discretionary refunds merely because you change your mind after a digital product or feature has been delivered or activated.
This policy does not limit any cancellation right or any right to a refund, repair, replacement, repeat performance, price reduction or other remedy that cannot lawfully be excluded, including rights relating to a product or service that is faulty, unavailable or materially different from its description.
For a website purchase, contact bobby@racount.com if you believe a payment was made in error or the product was not supplied correctly. For an app-store purchase, refund requests may need to be submitted directly to Apple, Google or the store that processed the payment under that store's rules. An approved refund may result in the related Racount entitlement being revoked.
Physical products are governed by the delivery, cancellation, return and refund information shown for that product. Nothing in these terms limits mandatory consumer rights for damaged, defective, misdescribed or undelivered goods.
7. Prices and Taxes
Prices are shown before purchase in the currency presented by the relevant payment provider or app store. The checkout process will state whether applicable taxes are included or added. You are responsible for charges imposed by your bank, card issuer or currency provider that are outside Racount's control.
8. Creator, Contributor and Payout Features
Racount may allow eligible travellers, creators or other contributors to offer content, products or services, share in revenue or receive other payments. Additional programme, marketplace or seller terms may apply and will be shown before a person participates. Those terms may cover eligibility, content standards, fees, payout timing, refunds, tax responsibilities and removal from the programme.
A payment provider may require identity, business, bank-account or tax information before enabling payouts. Participants are responsible for the accuracy of that information and for their own tax and reporting obligations. Racount or its payment provider may delay, withhold, reverse or suspend a payout where reasonably required to investigate fraud, resolve a refund or dispute, comply with law or enforce the applicable programme terms.
9. Racount Intellectual Property
Racount and its software, design, branding, logos, suggested counts, product catalogue and other materials are owned by or licensed to Racount. These terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the service. They do not transfer ownership of Racount's intellectual property to you.
10. Availability and Changes
We aim to keep Racount available and useful, but no online service can be guaranteed to operate without interruption. We may maintain, update, replace or discontinue features where reasonably necessary for security, legal, performance or product reasons. We will take reasonable care to avoid materially reducing a paid product without good reason and will provide any remedy required by applicable law.
11. Suspension and Account Closure
You can stop using Racount and request account deletion through the available account controls. We may suspend or close an account that materially or repeatedly breaches these terms, creates security or legal risk, or is used for fraud or abuse. Where reasonable, we will give notice and an opportunity to resolve the issue.
Deleting an account permanently removes access to content and account-linked digital purchases and entitlements. Those purchases and entitlements cannot be restored to a later Racount account. App-store purchase records may remain with the relevant store under its own retention practices.
12. Disclaimers and Liability
Racount is a travel journalling and tracking product. It is not an emergency, safety, navigation, medical, legal or financial service. You should not rely on Racount where inaccurate, unavailable or delayed information could put a person or property at risk.
To the maximum extent permitted by law, Racount is provided without implied warranties beyond those that cannot legally be excluded. Racount is not liable for losses that were not reasonably foreseeable when you agreed to these terms, or for business losses arising from personal consumer use. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, or limits mandatory consumer rights.
13. Privacy
Our Privacy Policy explains how Racount and its providers process personal information. By using Racount, you acknowledge that policy.
14. Changes to These Terms
We may update these terms when Racount, the law or our business changes. If a change materially affects your rights, we will provide reasonable notice through the service, by email or by another appropriate method. Changes do not retroactively remove rights that have already arisen from a completed purchase.
15. Applicable Rights and Disputes
These terms do not deprive consumers of mandatory rights or protections that apply in the country where they live. Please contact bobby@racount.com first so we can try to resolve a problem directly.
